Removing Negative Items

This is quoted word for word from someone in the industry. not intended to be a guide or a call to action but informative to let you know the state of the industry . Everything after this statement is quoted.


Step 1. The first thing we are going to do is go to annualcreditreport.gov and get a copy of all three reports. these work better than credit karma and other third party services because they have specific report numbers when they get issued. These are ATTACHMENT 1(exp) ATTACHMENT 1(TU) and ATTACHMENT 1(EQ)



step 2. Now we are going to make a list of all of our negative items, which should include the date opened, the balance, the original creditor and the collection agency.



Step 3. This one is going to take a little research, because I'm not going to give you mine. You have to find a decent sized metropolitan police force that accepts identity theft reports online. There are a significant number of them, though i don't know that most of them do. You want to find a municipality as close to where the target actually lives as possible. Fill out an online police report. They never follow up. List all the accounts you noted in step 2. They will send you a copy of your police report. Save that copy. This is ATTACHMENT 2



Step 4. Now, we are going to go to identitytheft.gov. File a report, listing each item. It might take multiple reports, as they only let you file five items on each report. If you have more than five just keep filing reports until you get them all. When they ask you if you've filed a police report say yes. Say you havent contacted the CRA or the creditors yet, since you haven't. Save all these reports as a PDF, this is ATTACHMENT 3.



Step 5. Make a copy of the individuals ID (front+back) A utility bill listing the individuals address, and the individuals social security card. These are ATTACHMENT 4(a), ATTACHMENT 4(b) and ATTACHMENT 4(c).



Step 6. Next we are going to send a letter to the three credit reporting agencies. The addresses are as follows:( always call in and check ask where to send letters anything can change )

Note the accounts listed on the bottom (progressive and credit one)... that is the way you are going to list accounts in collections, speicfy both the original creditor and the collection agency. When listing the furnishers of information, list both the original creditor and the collection agency. When listing the account numbers, list them precisely as they appear on the credit report you pulled from that agency. Include all the attachments listed, which you should have from the previous steps except for FCRA605B, which you can download from identitytheft.gov Step 7. Next, we are going to write to the collection agencies. This is the template to use:

I am a victim of identity theft. An identity thief used my personal information without my permission to open the following account:

That account is now in collections with your agency.  This debt is not mine. I have no knowledge of this account and it was opened and used without my knowledge or consent.   I have filed identity theft reports with both the local police and with the FTC.

I have enclosed a copy of the Consumer Financial Protection Bureau’s Notice to Furnishers of Information. It explains your responsibilities under the Fair Credit Reporting Act (FCRA). The FCRA requires that debt collectors give an identity theft victim documents related to an account if the victim asks. Please send me copies of all records relating to the account, including:

Account applications made on paper, online, or by telephone
Account statements or invoices
Records of payment or charge slips
Delivery addresses associated with the account
Records of phone numbers used to activate or access the account
Signatures on applications and accounts
Investigators report

Pursuant to the FCRA, please:

1. Inform Credit One Bank that the debt is the result of identity theft.

2. Stop collection proceedings against me

3. Stop reporting information about the debt to credit reporting agencies

4. Provide me with the records I request

Again, you should have all attachments. Download the notice to furnishers from identitytheft [dot] gov. Step 8. Now, we send letters to the original creditors. We are going to do this both for accounts in collections, and accounts not in collections. Here is the template to use.

RE:  Unauthorized Account Opened With My Information

Dear Sir or Madam:

I am a victim of identity theft. I recently learned that my personal information was used to open an account at your company. I did not open or authorize this account, and I therefore request that it be closed immediately. I also request that XXX absolve me of all charges on the account, and that you take all appropriate steps to remove information about this account from my credit files.

Enclosed is a copy of my FTC Identity Theft Report supporting my position, a copy of the police report filed with my local police department, and a copy of my credit report showing the fraudulent items related to your company that are the result of identity theft.  Also enclosed is a copy of the CFPB’s Notice to Furnishers of Information, which details your responsibilities as an information furnisher to credit reporting agencies (CRAs). As a furnisher, upon receipt of a consumer’s written request that encloses an Identity Theft Report, you are required to cease furnishing the information resulting from identity theft to any CRA.

The Notice also specifies your responsibilities when you receive notice from a CRA, under section 605B of the Fair Credit Reporting Act, that information you provided to the CRA may be the result of identity theft. Those responsibilities include ceasing to provide the inaccurate information to any CRAs and ensuring that you do not attempt to sell or transfer the fraudulent debts to another party for collection.

Please investigate this matter, close the account and absolve me of all charges, take the steps required under the Fair Credit Reporting Act, and send me a letter explaining your findings and actions.

If you send all these out on day 1, everything should be gone by day 10



EDIT:



couple more things i should specify if youre using this for creditjacking.



1. You should specify your phone number (or a phone number you have access to) and use your drop address in the address field for the CRAs. At the end of the CRA letter, you can add "There are numerous addresses and phone numbers on my report that I do not recognize. The above address and phone number are the only valid means to contact me. Please set them as my current address and phone number on my credit report" This, especially the phone number part, will remove a major hurdle for signature loans. You should also use this address and phone number (not the actual target address and ph) when requesting the report on annualcrediteport,gov. Even without the last paragraph, ive found the new address and ph# ends up on your report most of the time, and ive gone back and forth about adding the paragraph at the end.



2. I have found that, generally, if you have the right state and DOB, the license will pass muster about 2/3 of the time. If you have the right DLN, it will work almost every time.
